S.D.N.Y., February 2026. A defendant discussed his own pending case with a public AI chatbot. No lawyer was involved, and the consumer service's terms let the provider keep and use the conversations. The court held the chats were protected by neither attorney-client privilege nor the work product doctrine.

Massachusetts Superior Court, 2026. A represented plaintiff had case documents run through a public chatbot with no attorney involvement. The court compelled production of both the prompts and the outputs, writing that AI is a tool, not a person.
